These Terms of Service (the “Terms”) form a binding agreement between you and S3 Innovations LLC (the “Operator,” “we,” “us”) and govern your use of the Waggl iOS app and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
You must be at least 13 years old to create an account. If you are between 13 and the age of legal majority in your jurisdiction, you confirm that a parent or guardian has agreed to these Terms on your behalf.

“Your content” means everything you upload to or create in the Service: audio recordings, photos, notes, hive metadata, etc.
Waggl uses third-party AI services (currently Anthropic’s Claude for extraction and Deepgram for transcription) to turn your voice narration into structured findings.
The TestFlight beta of Waggl is provided free of charge. We may introduce paid plans in the future and will give beta participants reasonable notice before doing so.
If you share an apiary with another beekeeper, you grant them the rights described in their assigned role (owner, full access / editor, mentor / reviewer, or view only). The owner of an apiary can change collaborator roles or remove collaborators at any time. Inspections remain attributed to the beekeeper who recorded them.
The Service is currently in beta and provided “as is.” Features may change without notice, data structures may evolve, and brief outages may occur. We may also reset beta data when promoting the app to general release; if we do, we’ll notify beta users beforehand and offer an export.
We aim to keep the Service running, but we don’t guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Service for maintenance, security, or business reasons.
You can stop using the Service at any time and delete your account from Settings.
We may suspend or terminate your access if you violate these Terms, if your usage poses a security or legal risk, or if we discontinue the Service. We’ll give you reasonable notice and an opportunity to export your data when feasible.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI-EXTRACTED FINDINGS WILL BE ACCURATE.
WAGGL IS NOT A REGULATED VETERINARY OR AGRICULTURAL ADVICE SERVICE. IT IS A NOTE-TAKING AND RECORD-KEEPING TOOL FOR BEEKEEPERS. DO NOT RELY ON IT AS A SUBSTITUTE FOR PROFESSIONAL ADVICE WHEN MAKING DECISIONS THAT AFFECT THE HEALTH OF YOUR COLONIES, YOUR PROPERTY, OR YOUR LIVELIHOOD.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, WHETHER OR NOT INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
You agree to indemnify and hold harmless the Operator, our officers, employees, and contractors from any claim or demand arising out of (a) your use of the Service in violation of these Terms, (b) your content, or (c) your violation of any law or third-party right.
These Terms are governed by the laws of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Santa Clara, CA, and you and we consent to personal jurisdiction there.
If you downloaded Waggl from the Apple App Store, the following additional terms apply:
We may update these Terms from time to time. We’ll notify you in the app of material changes and update the “Last updated” date. Continued use of the Service after changes take effect means you accept them.
